In this essay, we examine the factors that drive local adoption of LGBT rights ordinances. Localities commonly pass these compensatory policies in the face of state inaction and when the locality has an unconventional political culture. We also address state preemption, local government power, and the influence of type of local government. We touch upon the referendum process and discuss different types of gay and transgender rights policies that localities might pass
